International case studies of historical rights

This report has compiled dossiers on all 39 international jurisprudences arbitrated on historical rights in international territorial disputes, including 21 cases of International Court of Justice (ICJ), 17 cases of International Arbitration Tribunal (IAT) and 1 case of International Tribunal for the Law of the Sea (ITLOS). The case-study reviewed original dossiers of close to ten million words and summarized the legal basis of the historical rights in international practices and defined the content, limits of application and the means of acquisition of those historical rights. The study also contains the comments and analysis on the cases made by the Arbitration Tribunal and the international community where we could discover the experience and influences on China’s historical rights in South China Sea.
